But in the face of Nokia's top-tier legal team it was not enough to save the embattled OEM.

During the testimony Nokia countered HTC's assertion that an injunction would be a "catastrophic" blow to the company's local presence by reveal details it had learned of an upcoming product launch from HTC.

The future looks much more bleak for smaller competitors like HTC, BlackBerry, and Motorola, all three of whom gave up share in the "high-tier smartphone market" to Apple. September brought "very weak" demand for HTC's flagship HTC One. The story was similar for BlackBerry, which saw "very soft" sales of its new Z10 and Q10, and Motorola, where sales for its refreshed Droid lineup declined after Apple's new iPhones became available.

Apple's September announcement pushed all but Samsung out of the picture and relegated the South Korean conglomerate's Galaxy S4 to the runner-up position across the board. Apple has maintained a significant edge outside of the U.S. as well, even before the long-anticipated launch of the company's devices on China Mobile, the world's largest wireless carrier. The iPhone 5s was "by far the top selling smartphone...at most channels where the smartphone launched globally. We revised shipment estimates for the iPhone upward to 54 million units in the first quarter of the company's 2014 fiscal year and 186 million units for the entire year.

The sales data also indicated strong Black Friday weekend iPad Air and new iPad mini sales...essentially at all channels where the iPads were available.

We estimate that a new relationship between China Mobile and Apple could generate 20-25 million incremental iPhone sales. We base this estimate on the assumption that China Mobile sells greater than 250 million smartphones, and Apple increases its market share into the 7.5%+ range. Several market research firms put Apple’s recent market share in the 5-15% range, despite not being officially supported by the largest carrier in China.

With its 755 million subscribers, China Mobile has added 60 million in the first half of this year.

Our assumption for greater than 250 million smartphone sales at China Mobile in 2014 is based on total smartphone sales in China of roughly 450 million units. China Mobile has 60-65% market share of mobile subscribers in China, but in the past the company’s subscribers have been less likely to purchase smartphones possibly due to the limited 2G network. With the upgrade to LTE, we expect China Mobile’s subscriber base market share will approach its share of smartphone sales.
