在台灣歐...
如果對方是窮到快餓死到你家撿垃圾, 但是被你誤以為是小偷打死, 這是正當防衛...
如果是高官的兒子(或是有背景的)因為看你不爽打你, 你就算只是推他都是防衛過當...
在歐美, 只要你的生命受到威脅, 你反抗結果一推他,頭撞到硬物格屁了, 或是情急之下拿出武器結果一擊打中要害掛了... 這算是正當防衛...
但是如果倒地後還有生命跡象但是已經神智不清, 或是武器擊中非要害但是已經癱瘓對方...你還繼續攻擊致死, 這是防衛過度...
不過這有一個問題... 人在極度緊張下很容易繼續攻擊... orz
