嗯，憲法第一修正案所保障的言論自由指的是政府機構，不適用於私營企業
以往類似案子都以敗訴收場，他的律師一定知道，他自己也說不想回推特要專心經營自己的平台，那為何還要多此一舉打這種官司？

這要看解釋憲法的大法官傾向。
有一派認為憲法只能照文字解釋，不能超譯。
另一派認為要尊崇憲法「精神」，可以擴充解釋。
