HTC can run but it can't hide - from Nokia's patent assertions on three continents.
自2012年四、五月間伊始,Nokia對HTC的專利侵權訴訟持續升溫,從起初的德、美兩地,延伸到義、荷、日三國,專利火網遍及亞、歐、美三大陸。稍早前HTC德國遭控後,在英國首控Nokia,意在先發制人,擬英國勝訴能挽回劣勢,影響德國判決;未料反遭Nokia回擊,迎來禁售令。目前HTC在德、英跟美國ITC三處已敗訴。HTC雖上訴英國成功,延緩執行禁售令,然關鍵的德國訟案即將在今日宣判,跟著是荷、義兩處訟案,美國部分亦將由ITC開審Nokia第二樁對HTC的控告。
除了爭議中的SEP濫用(涉及Samsung、Motorola、Nokia)外,Nokia本身仍擁有大量non-SEP!
For non-SEPs, it's going to be a long shot for anyone trying to build an antitrust abuse theory. No antitrust regulator in the world has the authority to require Nokia to give away licenses to its patents for free, or to tolerate infringement. In principle, Nokia can sue until HTC pays. That's what it's doing and what it will continue to do. And the day will come when HTC will agree to pay.
