很多金額高的嚇人的都是法院判的"懲罰性賠償", 是用來懲罰犯錯的一方, 或是補償受害者的精神損失, 而不是一般的民事損害賠償
損害賠償則包括財產損失, 醫療... etc,
通常只要有誠意, 願意負責, 法官通常都不會太為難犯錯的一方. 甚至會斟酌減輕賠償...
以加拿大來說, 法律規定普通的 General damage 賠償最高就三十萬 CAD,
但是有過高達兩百萬的懲罰性賠償記錄
同時, 在判決的時候, 也要看受到的傷害, 造成的後續影響, 再來判賠
物理的傷害很明顯, 但是精神傷害卻不容易判斷...
這就是要看法官的自由心證與其他證據, 是真的有這情況, 還是假裝的?
國外高達幾千萬的賠償, 究竟是真的損失這麼多還是因為附加了懲罰性賠償才有這麼多? 要先搞清楚啊... 兩者的性質完全不一樣...
