The Act gives quidelines to follow. There are 'buts' everywhere if you look and read very closely. Besides, if you signed contract with property ltd, there would be more underlined and realistic scenario as following blah blah blah. The manager still has some certain rights to invoke against a tenant. Laws are contradictory.
Usually, the one taken on more responsibility is given more power. However, it is also their responsibility to govern and inspect. Thus the Tenancy Act is only as good as how you act according to it. Don't charge yourself with the listings in the act and up against the manager and ltd. I trust them will only interfere when they deem necessary. Only the constitution is solid enough, others are set one against each other and see which gets implement as to fit the case.
Don't just check one Act that's to your advantage. How about checking theirs? Better yet, borrow an actual copy of the apartment contract. What you have only frighten the landlords who don't understand that they have rights as well as against this Act.
法律正確性很花時間, 看是屋主要花時間去查你, 還是你要花時間去對抗屋主. 一旦搞到那樣不論結果, 大家都會很難看. 互相尊�**晹釵菢咫~是最佳的方案, 不要想依據的法律效力就無所懼, 都是相對的, 法律是guideline! 是應當遵守的規範! 而不是絕對. 只要能夠擁有證明來支持自己, 哪邊的法律就會獲勝, 有力的不是法律, 而是證據, 當然也有收集證據的過程是否合理.
但想想, 就算過程不合理, 房東輸掉一個CASE, 如果房客最終還是有違規的地方, 那是絕對不可能毫髮無傷的走開. 所有使用法律的結果都會留下紀錄, 不然就是私底下, 但私底下就沒有法律保障. 自己的不敗之地只有自己的遵守法則, 不是依仗條文..
我好像很久以前就在PCDVD上做過粗淺的法律分析, 畢竟我不是專職, 只是有修幾堂法律課. 但很基本的法律相關, 分類, 運用, 還有熟讀過幾個同類引用相同條文卻結果截然不同的CASE, 那時就知道了, 教授告誡過的, 單一的法條不是唯一.
我都租房子, 也租公寓, 那麼多年了, 就算不讀法律的課, 我也知道自己有哪些rights, 也知道房東, manager的行為準則. 當然週遭的各種例子也看過不少, 所有事情都可以debate, 就算是你的Tenancy Act也是有放一個exception可以用, 就是(c)的部份, 同意書還可以另外寫, 看雙方當時有沒有接受, 然後簽字. 所以啦, 別把規範拿來充硬, 如果兩邊都很懂, 那是沒用的, 法律都是有留但書, 或特例的.
