「租霸」 3年騙慘6房東

買房出租，坐享租金收入與房子增值雙重利益，是許多民眾的致富之道，但卑詩省租務法規偏向保障租客權益，萬一遇到專業「租霸」，藉由法律漏洞不斷上訴，拒不遷出又可免費續住，對房東而言將是一場花了錢卻不能消災的「惡夢」。一些身受其害者呼籲省府修改上訴制度，保障房東權益。

「租霸」消息時有所聞，維多利亞市（Victoria）就出現一名專業「租霸」，三年內換了六位房東，讓房東吃足苦頭。

這名租霸名為賀特比（Orion Alexander Holtby），他在分類****網站上表示自己是軟體工程師，因遭不良房東欺騙，一家人包括兩名年幼子女無家可歸，想找房子租。維多利亞女子羅雅拉（Margarita Loyola）出於善心，與賀特比連繫，雙方商議租約條件後，賀特比提供雇主及推薦人（reference）連絡電話。

房東在簽約前打電話給這些推薦人查證，所得到的簽案都是賀特比是一位「模範租客」，於是不疑有他，去年9月將房子租給他。

豈料不久就收到銀行通知，指賀特比所付的租金支票退票，羅雅拉才驚覺上當，原來那些推薦人電話都是賀特比申請的，啟用一兩個星期後就取消，專門用來矇騙房東。

由於賀特比入住後一分錢都沒付，她向卑詩住客租務辦事處（B.C.'s Residential Tenancy Branch）申請強制搬遷令，但直到今年1月才把他趕走，但整棟房子給搞得面目全非，到處都是垃圾，還要花錢請人清理。

鑽法律漏洞 房東很無力

原來每當租務辦事處頒布「搬遷令」，賀特比就藉法例漏洞向法庭提出上訴，法官憑其一面之詞就決定給他更多時間，讓房東充滿無力感。後來她才知道自己不是唯一的受害者，過去三年此人用同樣手法，吃定其他五位房東，白住好幾個月，是名符其實的「租霸」。

另一名受害房東羅伯森（Dwayne Robertson）表示，去年為了將賀特比趕走，花了他超過1萬元，他說租務辦事處人員早就認識這名「租霸」，儘管搬遷令很快發下，但只要賀特比提出上訴，就拿他沒轍。

他們認為現行上訴制度有問題，完全不考慮租客過往紀錄，也不給房東申訴機會，只要租客說房東要趕他們走，但他們想留下，法官就會受理，有時一拖就是三個月，對房東相當不公平。

省府不願就此個案表態，僅強調房東應做的第一件事就是仔細查核租客信用紀錄，包括過去房東的評語等。
